Terms and Conditions

This is important information for both of us. It explains how I will look after your interests in terms of matters such as your data. It explains how I will deal with items which may be faulty. It also covers some items such as my own interests regarding how you may use my designs, which are fundamental to my livelihood. I have tried to make this section easy to understand but if you are unclear about any aspect, please contact me.

This website is the property of Debbie Bulford trading as Debbie Bulford Designs. I use Wix as site provider.

These Conditions, along with my Shipping, Returns and Privacy policies govern your use and access to this site.

These Conditions do not impact your statutory rights and these Terms for the sale and supply of goods will be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction with respect to any dispute arising under this Agreement.

From time to time, it may be necessary to vary these Conditions and when this happens, the changes will supersede this set, which is effective from 29 March 2020. If any part of them is inaccurate or invalid, this will not impact the remainder of them. If you choose to place an order with me, I will assume you have read these Conditions and Terms and accept them. Please note you must be over 18 to make purchases.

Placing orders

I follow the usual online shopping routines of asking customers to add items to a cart and when they have finished, to go through a checkout process.

I use Worldpay to handle my customers' payments, which allows you to use a number of online payment methods. I am not able to accept payments by cash or cheque.

At all times, your financial information is completely secure within their systems and I do not have sight of it. If you wish to know more about Worldpay, here is a link to their website.

When you place an order, you are making an offer to purchase goods which, if accepted by me, will result in a binding contract. You will receive an email confirming that the contract is formed.

I try to make sure all prices on the site are accurate but mistakes can happen and if I find one when an order is placed, I will tell you so you can either cancel the order for the impacted item only or accepted the revised charge. 

Prices will also change from time to time and such revisions will apply to future orders which you might place. Any orders being processed will not be affected.

Cancelled orders and returns policy

I try to ensure that the availability of items in the Shop is up to date but it may not always be accurate. If you order an item which is actually out of stock, I will email you to see if you wish to cancel your order for the item in question or choose an alternative.

There may be occasions when you will need to return faulty or incorrect items to me. Before doing so, please tell me about the matter by email within two days of receiving the goods, providing a description of the problem and also your full address and contact details. In these situations, I will cover the return cost for the item.

If you make a purchase and then change your mind after receiving it, you can return it, subject to some conditions. You must tell me by email within two days of receiving the item and it must be returned at your cost within 5 working days of this email, in its original packaging and in a condition that allows me to resell it. Refunds will only be made when these conditions have been satisfied.

These provisions do not apply to digital downloads , which cannot be returned, exchanged or cancelled. There is a specific set of terms for these items, shown below.

Digital downloads

When you purchase a digital design on my site, you are buying a set of 3 digital files (SVG, DXF and EPS) which can be used across a number of software programs and cutting equipment.

After you have checked out and completed the transaction for a downloadable digital item, you will receive an order receipt by email, containing a temporary link for you to download the item.

The download will comprise a ‘.zip’ folder containing the digital file you purchased in three separate formats (.SVG, .DXF and .EPS). You can then extract the files from the zipped folder, choose which file type suits your software or equipment and start using it. There will be no watermark on the images you download.

 

The file type used by individual machines and software differs manufacturer by manufacturer, so here is a guide to their compatibility, as at March 2020: -

SVG files can be used with Cricut Design Space (read more at http://bit.ly/2T146JYCricut), Silhouette Studio (read more at http://bit.ly/2uNHXqqSilhouette), Brother ScanNCut Canvas Workspace, Adobe Illustrator, CorelDraw, Sure Cuts a Lot software

DXF files can be used with Adobe Illustrator, RDWorks, IrfanView, AutoCAD, CorelDraw

EPS files can be used with Adobe Illustrator, CorelDraw, Gravit.

Important notes: -

  • These are digital files which give you a design, not a finished item. You will need to use them with a means of output, such as a die cutter or printer, unless you intend to use them with a software package such as Adobe.

  • You will need to have software capable of unzipping the folder. Your computer probably already has this but if not, there are numerous free sources via a Google search.

  • I do not have the resources to provide technical advice on downloading or using the files, but you will find a huge number of websites with instructions on how to do so, including equipment manufacturer sites.

  • If you are unsure about which file to use, you should always check specific file compatibility on your machine or software manufacturers’ website before you purchase or use them.

  • In addition, if unsure, you should check that your software can resize the image in the file, if you need it to. If you are using several images together, remember to resize them all so that they stay in proportion and scale.

 

Use of these images

All of the items and images on my site are provided for personal or small commercial use only on hand crafted items made by you.

As I have said elsewhere, the hand-drawn designs I produce are a cornerstone of my business and livelihood, so I need to protect their use.

If you wish to use them in digital items or on a large-scale commercial basis, please contact me first so we can discuss terms for their wider use.

Similarly, if you have a project in mind and have a question about what is permitted please contact me before purchase.

These designs and files are not for resale or distribution in any form or under any circumstances without my prior agreement. Please contact me if you are considering this.

Delivery & returns

Digital download orders cannot be returned, exchanged or cancelled. If you have any problems with the receipt of your order, please contact me by email within two working days of downloading files.

Your purchased files are available automatically once payment has cleared. If you have issues downloading, please send me an email and I'll help ASAP.

Shipping

I aim to despatch orders within 5 working days and if for any reason I am unable to do so, I will tell you.

Delivery charges are based on the packaged weight of all products in an order. If a package is damaged when it reaches you, please do not accept it and then tell me straight away. If you accept delivery and subsequently discover an issue, I have no recourse to the carrier and will not be able to claim compensation as a result.

Most orders are sent by first class Royal Mail post but in exceptional cases, I will use an alternative courier such as UPS or DPD. All orders will be sent using a 'tracked and signed for service' and once the order is recorded as delivered to you, the supply contract between us is completed.

If a tracked UK Royal Mail order doesn't reach you with 14 working days, please tell me as this will be classed as lost by the Royal Mail and I will arrange to refund or resend the order.

Privacy and the use of your personal data

The General Data Protection Regulations came into effect on 25th May 2018 and I follow their requirements. I therefore want to be transparent about the data you supply when buying or subscribing via the website and how I keep it safe.

Your data

When you click the ‘Subscribe’ form and enter your email address, the information is stored and I may use it in the future to send you updates about new products and related matters that I consider may be of interest to you.

My website is hosted by Create and they provide this platform to sell products to you. As part of the sales process, the website collects personal information you provide such as your name, address and email address. This is stored through Wix’s data storage on a secure server behind a fire wall and used for a postal address and any correspondence regarding the transaction. The only other reason I may use your information is to inform you of new products, events or problems with delivery.

I DO NOT sell or trade any email lists with any other organisations or businesses.

Google Analytics

When someone visits www.debbiebulforddesigns.co.uk, the website records this using a Google Analytics tool. This only compiles routine site visit metrics for me, such as how many people have visited our site and which pages they view. No visitor names are stored to identify anyone and I do not allow Google access to any other information to identify those visiting the website.

Giving you access to your personal information

You are entitled to view, amend or delete the personal information I hold.

You can request this any time or unsubscribe by sending me an email via the site ‘Contact’ page. I will delete or amend your data accordingly and send an email to confirm this has been done.

My Angel Policy for physical products

To ensure that both of us are protected from the misuse of images or text, I have established an Angel Policy. This protects all crafters, so if you want to sell your handmade creations you can. You are welcome to link to my images for your own inspiration or use on Pinterest if you include a link back to me, but please do not copy my images to your own website/blog.

There are no limits as to how many items can be made and sold using my images, book designs, kits and products and I do not regulate where those items are sold. I only ask that you do not claim the designs as your own, the products are not copied for onward sale as your own and the instructions are not electronically reproduced.
